1 Appellant, Al Hanf, d/b/a The Body Shop, hereinafter referred to as defendant, was convicted in the District Court, Tulsa County, Case No. CRF 73-2110, for the offense of Selling a Magazine Showing Acts of Sexual Intercourse in violation of 21 O.S. 1971 ? 1040.51 [21-1040.51]. His punishment was fixed at seven (7) years imprisonment and a Seven Thousand ($7,000.00) Dollar fine. From said judgment and sentence an appeal has been filed with this Court.
